Australian Tribunal Dismisses Italian Chef's Unfair Dismissal Claim
A Brisbane restaurant fired the chef following conduct complaints and a dispute over preparing pineapple pizza.

Australia's Fair Work Commission has rejected an unfair dismissal application filed by Italian chef Davide Tamburella following his termination from a Brisbane restaurant. The workplace tribunal dismissed the case because the chef submitted his paperwork past the statutory deadline.
Tamburella was dismissed in May from the now-closed La Costa restaurant in Brisbane after a series of workplace disputes with management. Central to the conflict was the chef's refusal to prepare ham and pineapple pizzas for a function, which he argued was an insult to his Italian heritage. According to tribunal findings released on Tuesday, Tamburella had maintained that instructions from management were not binding if they contradicted his cultural values.
The ruling noted that the incident marked the third time in four years that Tamburella had refused to include pineapple as an ingredient on a pizza. On a previous occasion, he had requested that his employer research the cultural significance of the dish to Italians. The state of Queensland, where Brisbane is located, produces all of Australia's commercial pineapples.
Beyond the dispute over ingredients, management raised concerns regarding the chef's conduct and communication style. The tribunal records showed that management cited instances of foul language, workplace frustration, and an April incident during which Tamburella fractured bones in his right hand after striking a metal rail. Managing director Elliot Ingram stated that the dispute extended beyond the issue of pizza toppings.
Prior to his dismissal, Tamburella was seeking employer sponsorship for a skilled worker visa to gain permanent residency in Australia, a process the restaurant terminated upon his firing. Public professional records indicate that Tamburella has since taken up a culinary position at a different restaurant in Brisbane, where pineapple is not listed on the menu.
